Terms & Conditions
Effective Date: October 7, 2025
These Terms & Conditions (“Terms”) govern all services provided by Loom Eatery & Café, LLC (“Company,” “we,” “our,” or “us”), operating as Private Chef Christopher LaMagna. By booking an event, submitting payment, or confirming a service, the client (“Client,” “you,” or “your”) agrees to be legally bound by these Terms.
1) Scope of Services
We provide private chef experiences, tastings, catering, and event dining throughout Manhattan, Brooklyn, Queens, Nassau, and Suffolk County, NY. Services outside this area may be available upon written approval and may incur travel fees.
2) Booking & Deposits
A 30% non-refundable deposit is required to secure your event date. The remaining balance is due immediately following the event unless otherwise agreed in writing. No booking is confirmed until the deposit has cleared.
Deposits and payments are processed securely through Stripe via our booking calendar. By submitting payment, you authorize the Company to charge your provided payment method for agreed amounts.
3) Minimum Guest Counts
Each package has a defined guest minimum. Pricing for fewer guests will reflect that minimum. Final guest count must be confirmed at least 7 days before the event; reductions after that point will not reduce the total price due.
4) Client Responsibilities
- Provide adequate kitchen space, power, and access for at least three (3) hours before start time.
- Ensure venue safety, cleanliness, and proper refrigeration for perishable items if applicable.
- Disclose all allergies and dietary restrictions in writing prior to event day.
- Provide legal parking or unloading access for chef and team vehicles.
- Assume full responsibility for guest behavior and any damage caused to property or equipment.
5) Alcohol Service
We are not licensed to sell or transport alcohol. Alcohol may be supplied by the Client and served by our staff, in compliance with New York State Liquor Authority regulations. The Client is solely responsible for ensuring lawful purchase, transport, and service, as well as obtaining any required event permits. Cancellation due to noncompliance with alcohol laws or venue policy is considered a client cancellation under our Cancellation Policy.
6) Cancellations & Rescheduling
Cancellations and rescheduling are governed by our Cancellation & Rescheduling Policy. All deposits are non-refundable. Reschedules within the specified timeframe may be allowed at the Company’s discretion, subject to availability and applicable fees.
7) Pricing & Taxes
All prices are estimates until final invoice confirmation. Applicable New York State sales tax will be calculated on the final invoice total. Ingredient costs and vendor pricing may fluctuate; the Company reserves the right to adjust pricing with notice prior to event execution.
8) Force Majeure
Neither party shall be held liable for failure to perform due to circumstances beyond reasonable control, including but not limited to natural disasters, illness, accidents, power outages, or government restrictions. In such cases, both parties will make best efforts to reschedule. If rescheduling is impossible, a refund will be issued minus documented costs incurred.
9) Liability & Indemnification
The Company’s total liability for any claim shall not exceed the total amount paid for the specific event. The Client agrees to indemnify and hold harmless Loom Eatery & Café, LLC, its staff, and affiliates from any claims, damages, or expenses arising from guest actions, unsafe venue conditions, or violation of alcohol laws.
10) Media & Photography
We reserve the right to photograph or record food and event setups for promotional purposes, provided no personal likeness or identifying information of guests is used without consent. Clients may request in writing that no photography be taken during their event.
11) Confidentiality & Privacy
All client information is handled according to our Privacy & Data Policy. We respect your privacy and never sell or share personal data outside of essential business functions.
12) Dispute Resolution & Governing Law
These Terms are governed by and construed in accordance with the laws of the State of New York. Any disputes shall be resolved through binding arbitration in Suffolk County, NY, in accordance with the rules of the American Arbitration Association. Each party shall bear its own legal fees unless otherwise awarded by the arbitrator.
13) Updates & Acceptance
We may amend these Terms periodically to reflect changes in operations or legal requirements. The latest version will always appear on this website. By continuing to engage our services after updates are posted, you agree to the revised Terms.
